Yes, that is correct. Murder in the broad definition isf the taking of another life, and can fall under any of the catagories described above from 1st degree to involuntary manslaughter. Factors to be considered include was the act committed with or without malicious intent, without or without premeditation, which can be but a moment's thought, with or without "special circumstances," meaning especially cruel and haneious, lying in wait, utilizing the use of a firearm, etc. It is at the descretion of the prosecutor, which catagory a particular case of "murder" is tried under. And unless it is a federal charge, each states has different sentencing guidelines.
