Oh Kim, I'm so sorry all of this is happening. You seemed so happy to be working with this rescue and getting kittens in again to help, and I can only imagine the heartbreak at having to hand over Bearess and Tiny Tuxie (nooooooo!). I hope and pray that like you say, now that she is under the microscope that all her animals get only the best of care.
As for worrying about being investigated yourself, the best approach might be instead of waiting for them to come to you, go to them and tell them what you're trying to do and ask for help in setting up a non-profit organization. A lot of counties/cities/states offer free help to new businesses to help get them up and running.
Here is a link to information on what is needed to set up a non-profit in Tennessee. This might seem like a lot of work in the beginning, and will take money - probably to pay a lawyer to set up the non-profit correctly - but in the long run it will only benefit you and what you are trying to do for the kitties.
