The kitten's welfare is of most importance, so I'd do whatever's best for the kitten (but probably ring the animal welfare people first to see what the penalty is for taking the kitten ...) Maybe animal welfare could talk to the owners first about responsible pet ownership, then you could take matters into your own hands?
