ACTUALLY RICHARD IF HIS TREE AND ITS ORANGES ARE ON YOUR SIDE OF THE FENCE, THEN THEY ARE YOURS BY LAW.

That's what I thought, too. If he's the religious sort, tell him that you're engaging in the Old Testament practice of gleaning. They'd allow the first 10 rows of whatever was planted to be gleaned by the poor. That should shut him up or loosen him up, at least.
