The prosecutors job is to prosecute. The police's job is to investigate the crime and bring to the prosecutor all the facts to get a conviction. If, and I did not read the story, the prosecutor felt there wasn't enough to go on to get a conviction, that isn't the prosecutor,s problem.

This attack on the Petting Zoo deer happened last weekend. yesterday
I learned something I hadn't know before. The idiot who climbed the fence
and killed the deer started a new job this week. He has been hired as a
Correctional Officer in a nearby town.

I hope at least one of the inmates is an animal lover and they give him
an appropriate welcome.
