As someone that practices in the area of malpractice, I can tell you first hand- medical malpractice cases are the most expensive to try, and the most difficult to win. The ONLY case that gets to trial, or even past a motion for summary judgment, is that case in which the person has a significant injury- loss of life, limb, paralysis, permanancy. Anything else, it isn't worth the client OR the attorney's time to pursue.
Malpractice litigation happens because doctors refuse to be like the rest of us, imperfect human beings, capable of minor, major or agregious conduct. When INSURANCE companies stop practicing medicine, we all will be much better off.
