On November 3, 2011 at 10:30 am we will set down with the TOP mediator/arbitrator in Calgary to settle our property issues. This will be the final step in the process, hopefully. Then it will be all over and I can finally move forward. If he fails to show then the saga continues.....
Is there any legal recourse - like arrest - if he fails to show? Best of luck!
I was wondering the same thing. Wouldn't he be in violation of a court order if he doesn't show up? I still can't believe how he somehow got away with all that he has done so far. Here in this state, if you fail to appear for anything, a bench warrant is issued.
If he fails to show it will be recorded, as the previous 3 occassions have been, we will then proceed directly to court in front of a judge and the judge will hear it all and make a decision. Really not in his best interest to go this route. I expect he will show and try to intimidate me. I will however have my lawyer there and she'll eat him for lunch if he gets stupid.
Going to be a bad IBS day regardless. Just have to get thru it and then it's ALL OVER. The thought of being in the same room with him makes me feel very, very unwell.

Received the revised Mediation/Arbitration agreement late yesterday. It is now in its proper form, if we cannot agree on things the mediator will abritrate a decision. Her decision will come 45 days following the end of the mediation session. I will be signing this agreement and providing the required retainer. I am not sure he will agree to this at all, so we will just have to wait and see. The agreements and retainer have to be signed and returned by Oct 28. I will spend 2 hours with my lawyer on Monday, Oct 24 to do our preparation for the med/arb.
The count down is really on and I'm finding I'm very nervous and excited at the same time. Nervous to be in the same room with him, excited to be finally almost done with him. It will be nice to have this stress load out of my life.

He has signed the mediation/arbitration agreement. We will proceed Thursday, November 3 at 10 am - likely for the entire day.
....hopefully in a week it will be all over.....hang in there, stay strong!
I so pray that this ordeal will finally end and you can get on with the next phase of your life. You have done such a fabulous job of staying strong, you deserve a fabulous new beginning.
