Then I put Bear outside to potty & thought to myself... Theres no way Andrew would have just taken the SUV... So I looked at Andrew's parking spot & his car was gone... Hmmm thats strange... I put Bear back into the kitchen to eat & saw the SUV key on Chad's wallet... ok now thats very strange! There is only 1 key to the SUV.

I woke up Chad & said the SUV isn't in our parking spot. He moaned, so I gently rubbed his back & repeated myself... That woke him up & he got upset thinking I was lying to him... Thats when I knew for sure it was stolen. I said I'm not kidding, I can't find the SUV, its not there!! Maybe I'm blind, but I swear I cannot see it!!

I have never seen him get up so fast from bed & get dressed. He rushed out the door & said, OMG Bill's going to kill me!!!

He called the police to make a report, but since we didn't have the VIN#, they couldn't help us. That didn't help us from panicking! We put our coats on & rushed over to the supers. They were off duity "of course", but they have a life too. So we walked all around our complex, "just incase".. no luck...

We stopped at our friends to let them know the SUV was stolen. Chad then got a phone call telling him the police towed the SUV as it was reported stolen

A lady with an italian or polish accent called it in.

First off, anyone in the complex is suppose to call management about getting cars towed, or they are to call the tow company thats for the complex.

This lady with the accent is believed to be our neighbour, as she has put a lot of bogus complaints in against us.

She knew if she called management then they would have known it was our SUV as our spots have been noted that we will have random autos in our spots that will not have plates on them... As they are dealer cars & dealer plats can cost 800.00 to replace! So its safer to bring the plates into the house.

The dealership for sale sign was still in the front window. So that there tells you its "more then likely" NOT stolen, the plates are just inside the house.

Well the police officer felt it was best to have the SUV towed as stolen & recovered at 3:40am <-- remember it was never "reported" stolen!!

A police officer called us later in the morning & said sorry a million times about this, as it should NEVER have happened. She was very kind & made sure we knew we did nothing wrong, it was all their fault. She was even kind enough to call Chad's boss to let him know that it was the departments fault 100% & NOT to get upset at us, or have us fired (I help out at the dealership often, as a friend).

The police said we didn't have to pay any fee to bail the SUV out. We just had to go to their station so pick up the tow paper.

That was a FAR drive & took us forever to find it as we don't know Brampton, let a lone our own area (we're new to the area). Then we had to drive even further to the pound to bail the SUV out. My goodness!

We got the SUV & had to drive it all the way back out to the dealership. Now its 1pm & too late for me to drive all the way to my work, as I would have gotten there for about 2pm, leave at 5pm & have to go all the way back out to the dealers.. HA don't think so... So I lost a whole days pay :(

Our landlady is going to findout who called in our SUV, & IF it was our neighbour, shes going to make them pay for all the damages. Wadges lost & damage to the SUV. They towed it by the back end & thats a no no for our type of SUV. So now the poor SUV pulls all over the place & trying to turn sharp into a parking spot is interesting. It was shaking, making all sorts of grinding noises & resisted to go forward. *pets the SUV*

What erks us ontop of all that, is that we spent 20.00 having it washed & looking all perdy & when we got it, it was so filthy :(

Our landlady feels horrible about this all. She said we don't deserve to live like this, so she offered us a new unit.

We checked it out last night & it was an AUTO yes!!! OMG the front yard is 4x larger then our current yard, as its a corner unit!!! The layout is the same, but its slightly different & far cleaner!! Its still a mess, as they haven't finished cleaning out all the trash yet, but she said it'll be perfect by the end of next week... Then we have 2 weeks to move our stuff over, so we don't have to spend any money on a rental truck. Ohhhh Bear is just going to love how HUGE the yard is!!

So all this HELL has turned into some good :D

We are getting our landlady a very special gift for all her wonderful help & support. We are buying her 2 reservations for dinner at the CN Tower!!!

Bless your hearts ... what an ordeal! I'm glad that in the end, things turned out in your favor. I hope you can get this other tattletale tenant to pay up for your expenses!

What a nightmare! Poor you, but at least everything turned out almost okay, and the SUV is probably fixable, poor baby - it musta been traumatized!

kimlovescats, Our land lady was so upset she started crying :( It wasn't just our issue that set her off, but shes too kind of a lady & a nother tennet is sueing her, so our mess was just too much for the poor thing. She has loved us since day one, esp Chad (hes very charming), adopting dogs also put us into a special place in her heart as she just loves dogs & cannot wait to meat bear hehe She was also very pleased on how quickly we responded to the complaints against us & how we said we'll fix whatever we're doing wrong, but we still don't understand what we are doing wrong.

The problem with the SUV is that its being sold at 5999.00 & now the work that has to be done to it, not only is going to take a long time to fix, but more money.. so there'll be very little profit on it & thats really bad right now... we need every penny we can get... Reason the 3 of us donate our time there to help.
Chad is the Financial Manager.
I'm the Computer gal.
& Andrew does part runs.
Bill does kinda pay Chad, but its random & small.. but every penny we get helps us too.

I hope they can prove who made that call and she has to pay all those damages.. If it is that neighbor, SHE is the one who should be moving out!

We can find out who called it in, cause you HAVE to leave your info in order for the police to even show up for a call (unless its a 911 issue).

We agree with the landlady, that that lady needs to stay there, cause shes been there 30+yrs & have never missed rent. We are also the first people shes really gone after, so its us they don't like. We know why but its the 21st centery & they need to get over it!

But the other place is so worth the move!

If the police took the van " by accident" - hired a poor recovery company that did damage to the van- then they should pay for it.

Thats not true. the police are not liable for any damage they cause in Canada.

Shoot, I forget where this happened.. But the police (SWAT) busted down a door & trashed the house looking for drugs... They went into the wrong house

The home owners had to pay for everything!

YOU have GOT to be kidding????

Not kidding & I agree. because then criminals can get their damaged goods replaced as well, which is REALLY bad, considering the amount of times the police make errors (very rare)

Actually the police not paying for anything makes sense to me (even if I don't agree with it)- I bet if it were looked into it probably happens in the States too.
I have heard of many cases on the news where Bounty hunters (granted a whooollleee 'nother breed) break into hotel rooms and beat up people and verbally terrorize people then find out they have the wrong hotel branch, wrong room, or simply right room, wrong people. And they get NO KIND of punishment for doing it and the victim is made to feel like it is their fault being in the wrong place at the wrong time. Even tho if you or I did it we would be tossed into jail on our tails and the key thrown away.

I really Hope things get sorted out for you all.

In the states, a governmental agency (i.e., the police) would have governmental immunity for performing tasks that are regulated to them (towing a car, chasing a suspect, breaking down doors, among many other things), and not be liable for incidental damage. This carries over from the early thoughts, "The King can do no wrong". There are exceptions to governmental immunity, and most states have codified (in the states statutes).

Doesn't surprise me that this would be similiar in Canada, though there are some surprising facts in other parts of the OP.

Used to be the same in Indy, until recently. law was changed to allow
people to sue the city in cases of "wrongful death" while in hot pursuit
in fleeing car chases. (If police action in the chase injured a bystander,
not involved in the crime) That happened way to often in this city.
