In the case cited in the decision, there should have been no question.
However, the ruling is vague and lends itself to abuse by police, in a state with serious issues with abuse of police powers as it stands.
The one eyed man in the kingdom of the blind wasn't king, he was stoned for seeing light.
Sure wish they do the same for all abused animals.
